To whom it may concern,

This public records request is a follow-up to public records request #19-280. I am seeking written confirmation that there are no responsive materials for the following areas from public records request #19-280. The City neither produced nor affirmatively stated that no responsive materials existed in the initial response. I am further requesting that if any responsive materials do exist, but the City of Newton is withholding any of the following documents claiming that they are privileged, please identify the documents and the basis of the privilege.

1) A copy of the Massachusetts Central Register notice of the RFQ for the Design Services contract for any Newton Center for Active Living (NEWCAL) project contracts signed by the City of Newton and (Bargmann Hendrie & Archetype, Inc) BH+A in 2018 and 2019.

2) The list for firms responding to the RFQ for any Design Services contracts for the NEWCAL project signed between the City of Newton and BH+A in 2018 and 2019.

3) Any documents and/or materials related to the selection criteria and rankings of the responses including any notes or rankings/assessment sheets that resulted in the selection of BH+A for the Design Services for the NEWCAL project in 2019. This includes any ranking criteria, coding keys and criteria definitions for evaluating bidder quotes and proposals. (I am not requesting the actual bid responses.)

4) Any other Design Services Contract the City of Newton has entered into with BH+A that form the basis for any design services work for NEWCAL being performed by BH+A between January 1, 2018 and December 31, 2019.

5) The RFQ documents for any other Design Services Contract the City of Newton has entered into with BH+A that form the basis for any design services work for NEWCAL being performed by BH+A between January 1, 2018 and December 31, 2019.

6) The list for firms responding to RFQ documents for any other Design Services contract that the City of Newton has entered into with BH+A that form the basis for any design services work for NEWCAL being performed by BH+A between January 1, 2018 and December 31, 2019.

7) Any documents and/or materials related to the selection criteria and rankings of the responses including any notes or rankings/assessment sheets that resulted in the selection of BH+A for any other Design Services contracts that form the basis for any design services work for NEWCAL being performed by BH+A between January 1, 2018 and December 31, 2019. This includes any ranking criteria, coding keys and criteria definitions for evaluating bidder quotes and proposals. (I am not requesting the actual bid responses.)

8) Copies of any invoices and estimates for work received from BH+A for design work associated with the NEWCAL project from January 1, 2018 to August 18, 2019.
